How to initiate Mediation:
You will need the Consent to Mediate Dispute form.
OKCMAR members as well as citizens involved in a real estate dispute are encouraged to utilize the Oklahoma Supreme Court Network’s Early Settlement Program to mediate disputes. The purpose of utilizing the Early Settlement Program is to provide association members as well as members of the public convenient access to dispute resolution proceedings which are fair, effective, inexpensive and expeditious.

How to File for Arbitration:
You will need the Request and Agreement to Arbitrate (FORM A-1).
Please be sure to provide the name(s) and address(es) of all persons who are party
to the dispute and the dollar amount of compensation over which you are requesting
arbitration. Please support your request with a typewritten statement, signed by
all persons who are a party to this action.
In your statement, outline your complaint and attach all pertinent documents, such
as a listing agreement, the purchase contract, a closing statement, etc. The request
form should be returned as soon as possible to the Oklahoma City Metropolitan Association
of REALTORS®, 3131 NW Expressway, Oklahoma City, OK 73112.
Please provide enough copies of all documents to distribute to all persons named
as Respondents in the request. A $300.00 arbitration deposit is also assessed to
each party requesting arbitration. Payment must be received to begin the arbitration
process. Checks may be made payable to OKCMAR.
Upon receipt of the proper documentation, a copy of all materials will be sent to
the Respondent, and in turn, an informational copy of their reply, if any, will
be sent to you. Upon receipt of information from both the Complainant(s) and the
Respondent(s), the Grievance Committee will meet to consider the validity of your
request. All parties will be kept advised of the case status.
How to File an Ethics Complaint:
You will need the Ethics Complaint form (FORM E-1).
Please fill in, at the top of the Ethics Complaint Form, the name(s) and address(es)
of Complainant(s). In addition, fill in the name(s) and address(es) of the Respondent(s).
At the bottom, sign the form where indicated and include your telephone number in
the space provided. Use the enclosed copy of the Code of Ethics of the NATIONAL
ASSOCIATION OF REALTORS® to determine which Article(s) (of 1 through 17) the respondent(s)
has allegedly violated.
You must support your complaint with a typewritten statement outlining the Article(s)
of the Code of Ethics you believe were violated and attach all pertinent documents
that support your claim, such as listing agreements, purchase contracts, closing
statement, etc. If you need assistance in filing the complaint, contact the Association
office. We will then have a member of our Grievance Committee contact and assist
you.
Please provide sufficient copies of your complaint to distribute to each respondent.
Upon receipt of this information, a copy of all material will be sent to the Respondent(s)
and, in turn, informational copies of their reply, if any, will be sent to you.
After receiving the proper information from both sides, the Grievance Committee
will meet to consider the validity of your complaint. The Association will keep
you notified of the status of your case.
